All artworks, images, photographs, text, video, and other content published on this website (annesmerdon.com) and across all associated social media channels are the original creative works of Anne Smerdon and are protected by copyright under the Copyright Act 1968 (Cth) of Australia and applicable international copyright law.

What Copyright Means

Copyright arises automatically when an artwork is created. It does not require registration, application, or the display of the © symbol — though the symbol is used here to place the public on clear notice. Copyright in Anne Smerdon’s works lasts for her lifetime and for 70 years after her death.

As the copyright owner, Anne Smerdon holds the exclusive right to:

  • Reproduce her artworks in any form — printed, digital, or otherwise;

  • Publish or communicate her artworks to the public;

  • Create derivative works based on her artworks;

  • Sell, license, or otherwise commercially exploit her artworks; and

  • Authorise or refuse any of the above.

Moral Rights

In addition to copyright, Anne Smerdon holds moral rights in all her works under the Copyright Act 1968 (Cth). These are personal rights that cannot be transferred and include:

  • The right of attribution — to be identified as the creator of her works;

  • The right against false attribution — to ensure her name is not attached to work she did not create; and

  • The right of integrity — to object to treatment of her work that is derogatory or prejudicial to her honour or reputation.

These rights apply to the physical artwork and to any reproduction or image of it.

Sale of Artwork Does Not Transfer Copyright

The purchase of an original painting, print, canvas artwork, or any other work by Anne Smerdon transfers ownership of the physical object only. Copyright remains with Anne Smerdon in all circumstances.

Purchasing a work does not entitle the buyer to reproduce, publish, license, or commercially exploit that work or any image of it. For information about what a purchase does and does not include, please refer to the Terms and Conditions.

What You May Not Do Without Permission

The following uses of Anne Smerdon’s artworks and website content are strictly prohibited without prior written permission:

  • Reproducing, printing, or copying any artwork or image for any purpose;

  • Using any artwork or image in advertising, marketing, or promotional materials;

  • Applying any artwork or image to merchandise, products, or packaging;

  • Publishing any artwork or image on a website, blog, or digital platform for commercial purposes;

  • Creating derivative works, adaptations, or modifications of any artwork;

  • Removing, altering, or obscuring any watermark, copyright notice, or attribution;

  • Using any artwork in AI training datasets, model training, or automated image generation systems; and

  • Any other commercial exploitation of Anne Smerdon’s artworks or content.

What You May Do

The following personal, non-commercial uses are permitted without prior written permission, provided attribution is given:

  • Sharing images of artworks you have purchased on personal social media, with clear credit to Anne Smerdon as the artist;

  • Sharing links to this website or to Anne’s social media profiles; and

  • Using small reproductions of artworks for the purposes of news reporting, critique, or review, consistent with the fair dealing provisions of the Copyright Act 1968 (Cth).

Licensing

Anne Smerdon welcomes enquiries about licensing her artworks for commercial use, including publication, product design, advertising, and brand collaboration. Licensing is available on agreed terms and for a licensing fee commensurate with the scope, territory, and duration of use.

All licensing arrangements must be agreed in writing before any use commences. Anne does not grant exclusive rights through a standard sale, and any request for exclusive rights will be assessed on its individual merits.

Artificial Intelligence and Image Scraping

Anne Smerdon expressly prohibits the use of her artworks, images, or any content from this website for the purpose of training, fine-tuning, or otherwise developing artificial intelligence systems, machine learning models, or automated image generation tools, without prior written consent.

This prohibition applies regardless of whether the use is described as “research,” “non-commercial,” or covered by any claimed exception. Anne Smerdon supports the Australian Government’s position that artists’ works should not be used without consent for AI training purposes.

Anne takes copyright infringement seriously and will take appropriate action, which may include issuing takedown notices, seeking removal of infringing content, and pursuing legal remedies.
