Terms & Conditions

These Terms & Conditions apply to all bookings for live guest portrait services (“the Service”) provided by Anne Smerdon (“the Artist”). By paying the deposit, the Client agrees to the following:

1. Booking & Deposit

• A non-refundable deposit of 10% of the total fee is required to secure the event date.

• The booking is not confirmed until the deposit has been received.

• Dates are held on a first-come, first-served basis.

2. Final Payment

• The remaining balance (90%) is due prior to commencement of the live painting service.

• Payment may be made via bank transfer, online website purchase or cash.

• The Artist reserves the right to cease or withhold services if final payment is not received by the event day.

3. Event Details & Working Conditions

The Client agrees to provide:

• A suitable space (table + chair) with adequate lighting

• Shelter if outdoors

• Reasonable access to guests

The Artist reserves the right to adjust working position or pace if conditions affect the quality or safety of the work.

4. Guest Portraits & Time Limits

• Guest illustrations are completed live, in real time, and the number of portraits achievable depends on:

  • event duration

  • guest engagement

  • complexity of attire and poses

• No guarantee is made as to the exact number of illustrations completed.

• Portraits are stylised watercolour illustrations, not photographic likenesses.

5. Artistic Style & Creative Control

• By booking, the Client acknowledges familiarity with the Artist’s style.

• Artistic decisions (colour, simplification, brushwork) remain at the Artist’s discretion.

• Minor variations are part of the live illustration process and are not grounds for refunds.

6. Cancellations & Rescheduling

• The deposit is non-refundable under all circumstances.

• If the event is rescheduled and the Artist is available, the deposit may be transferred to the new date.

• If the Artist is unavailable for the new date, the deposit is forfeited.

• If the Artist must cancel due to illness or unforeseen circumstances, all payments made will be fully refunded, and no further liability applies.

7. Copyright & Usage

• All artwork remains the copyright of the Artist.

• The Client and guests may display their original illustrations for personal use only.

• The artwork may not be reproduced, sold, licensed, or used for commercial purposes (including merchandise, prints, marketing, or products) without written permission from the Artist.

• The Artist retains the right to photograph or scan the artworks and/or use images for portfolio, website, social media, and promotional purposes

8. Liability

• The Artist is not responsible for delays or reduced output caused by:

  • guest unavailability

  • venue restrictions

  • weather

  • interruptions beyond reasonable control

• The Client agrees that no refunds will be issued for factors outside the Artist’s control.

9. Guest portrait release

I, the organiser, give permission to Anne Smerdon to create portrait artworks of guests at this event and to use the resulting artworks in her professional portfolio, on her website, social media and for promotional purposes.

I understand and agree that:

1. The Artist retains full copyright and intellectual property rights in all artworks created and no payment or royalties are required from the Artist for the use of the artworks.

2. Guests’ participation is voluntary, and the artworks will be handled respectfully.

3. I, as event organiser, and any guests who have their portrait painted, do not have permission to reproduce, sell, license or profit from the artworks or to use them for commercial purposes such as products, prints, fabric designs, or merchandise.

10. Acceptance of Terms

Payment of the deposit constitutes acceptance of these Terms & Conditions in full.
